What is Copyright Disclaimer under section 107:-

A copyright disclaimer under Section 107 of the United States Copyright Act, 1976 (Copyright Act) also known as (Fair use Act) specifies the circumstances under which a person may use a work protected by a copyright without the owner’s consent.

The Copyright Act permits such unlawful use of copyrighted content when it fits the “fair use” definition and would otherwise constitute a copyright violation.

When someone incorporates a copyrighted piece of art, scenes from a TV show or movie, text from a book, or any other unique work into their own work, they must include a copyright disclaimer. A fair use of copyright disclaimer indicates that the user is utilising copyrighted content in accordance with the fair use clause but does not actually own the copyright.

  2. The purpose of the disclaimer should be stated, such as by asserting fair use in accordance with Section 107 of the Copyright Act.
  3. Fair Use Explanation: In the disclaimer, give a brief explanation of what fair use is and how it relates to using the work.
  4. Description of the Work: A description of the work being used, together with its title, author, and any other relevant information, should be included in the disclaimer.
  5. Use Restrictions: The disclaimer should clearly state the work’s use restrictions and the circumstances in which it may be used, such as for commentary or criticism, educational reasons, or as part of a body of work.
  6. Citation and acknowledgment: To acknowledge the author’s contribution and prevent plagiarism, a citation or acknowledgment to the original work ought to be included in the disclaimer.
  7. Contact Information: In order for interested persons to contact the owner for more information, the disclaimer should provide the owner’s contact information, such as an email address or website.

Implementing a Copyright Disclaimer 

The steps needed to include a copyright disclaimer statement in a work that has been copied are listed below:

  • Please include the publishing year.

The publishing year must be stated in the copyright disclaimer statement. It should be made clear what year the author first released the work through sale or leasing.

  • Name of the copyright author should be mentioned

The copyright holder’s name and the precise description of the author’s work that was used in the reproduction should both be included in the copyright disclaimer.

  • Insert the copyright symbol

The copyright symbol © should be used in the copyright disclaimer. The phrase “copyright” can also be used to indicate that a portion of a work that has been copied is protected by a copyright.

  • Attach a copyright disclaimer in a prominent location.

In the section of the duplicated work, the copyright notice needs to be placed or affixed in a prominent location. Typically, a copyright notice can be found in the footer of a website, at the bottom of a piece of composed music, or on a few pages of a book.

  • Include the statement of rights
