Copyright law is a body of regulations that prevents the original works of writers, singers, painters, and filmmakers from being used or duplicated without their consent. It provides the authors complete control over how people use, distribute, and exhibit their works.
These exclusive rights enable the production and dissemination of creative works that benefit society and our culture, fostering innovation and furthering knowledge by offering financial incentives to creators.
What is Copyright?
A person who creates an original piece of authorship, such as a literary work, music, movie, or software, is granted a set of rights known as copyright. You are the sole proprietor of any creative material that you produce and edit, such as a photo, a poem, a blog post, or a song.
The right to reproduce, create derivative works, distribute copies, perform, and publicly display the work is granted to you by the copyrights. Subject to specific statutory restrictions, copyright also gives the owner the ability to delegate these exclusive rights to third parties.
What is Copyright Disclaimer under section 107:-
A copyright disclaimer under Section 107 of the United States Copyright Act, 1976 (Copyright Act) also known as (Fair use Act) specifies the circumstances under which a person may use a work protected by a copyright without the owner’s consent.
The Copyright Act permits such unlawful use of copyrighted content when it fits the “fair use” definition and would otherwise constitute a copyright violation.
When someone incorporates a copyrighted piece of art, scenes from a TV show or movie, text from a book, or any other unique work into their own work, they must include a copyright disclaimer. A fair use of copyright disclaimer indicates that the user is utilising copyrighted content in accordance with the fair use clause but does not actually own the copyright.
Allowed Copyright content:-
The following uses of copyrighted content are permitted by the copyright disclaimer provided by Section 107 of the Copyright Act:
- Education and Research
- News Reporting
Section 107 specifies four standards to follow in determining whether a copyrighted use is fair:
- How it will be used, its purpose,
- The protected work’s composition includes:
- In relation to the total work, the number and significance of the parts employed, as well as
- The effects of use on the protected works in the potential market.
Different Forms of Copyright Disclaimers
These are the several kinds of copyright disclaimers:
- Disclaimer of warranty and copyright

Characteristics of copyright disclaimers:-
Authors can protect their work and alert others of their ownership rights by using a copyright disclaimer, which is a useful tool. Making sure a copyright disclaimer is accurate, helpful, and original is crucial.
A copyright disclaimer may have some of the following features:
- Explicit Statement of Ownership: A copyright disclaimer should make it clear who is responsible for the work being used as intellectual property.
- The purpose of the disclaimer should be stated, such as by asserting fair use in accordance with Section 107 of the Copyright Act.
- Fair Use Explanation: In the disclaimer, give a brief explanation of what fair use is and how it relates to using the work.
- Description of the Work: A description of the work being used, together with its title, author, and any other relevant information, should be included in the disclaimer.
- Use Restrictions: The disclaimer should clearly state the work’s use restrictions and the circumstances in which it may be used, such as for commentary or criticism, educational reasons, or as part of a body of work.
- Citation and acknowledgment: To acknowledge the author’s contribution and prevent plagiarism, a citation or acknowledgment to the original work ought to be included in the disclaimer.
- Contact Information: In order for interested persons to contact the owner for more information, the disclaimer should provide the owner’s contact information, such as an email address or website.
Implementing a Copyright Disclaimer
The steps needed to include a copyright disclaimer statement in a work that has been copied are listed below:
- Please include the publishing year.
The publishing year must be stated in the copyright disclaimer statement. It should be made clear what year the author first released the work through sale or leasing.
- Name of the copyright author should be mentioned
The copyright holder’s name and the precise description of the author’s work that was used in the reproduction should both be included in the copyright disclaimer.
- Insert the copyright symbol
The copyright symbol © should be used in the copyright disclaimer. The phrase “copyright” can also be used to indicate that a portion of a work that has been copied is protected by a copyright.
- Attach a copyright disclaimer in a prominent location.
In the section of the duplicated work, the copyright notice needs to be placed or affixed in a prominent location. Typically, a copyright notice can be found in the footer of a website, at the bottom of a piece of composed music, or on a few pages of a book.
- Include the statement of rights
The right statement (fair use clause) should be included in the copyright disclaimer statement to demonstrate the rights that the copyright owner is in possession of. Readers or viewers of the copied work are informed by a fair use provision that even when a copyrighted work is utilised for fair use, anyone wishing to use it for a purpose other than those listed in Section 107 must first seek the owner’s permission.
India Copyright Disclaimer :-
In the United States, the Copyright Act gave rise to the idea of “fair use” of copyright. However, other common law countries have a comparable idea. In India, Section 52 of the Copyright Act, 1957 specifies what constitutes “fair use” of a copyright.
By include a copyright disclaimer, it allows for the use and reproduction of the work that is protected by copyright. The following uses of the copyrighted work’s fair use reproduction do not constitute infringement:
- Personal and Private use
- Reporting of Current events and affairs
A copyright disclaimer can be used to legally duplicate a work that is protected by one. It will be considered infringement if someone uses a copyrighted work without including a disclaimer.
The fair use provision in the copyright disclaimer permits the use of writers’ and artists’ creative works while yet protecting them from infringement.
